Terms of Service
1. Acceptance
By creating an account or using membrAIn, you agree to these Terms and our Privacy Policy. If accepting on behalf of an organization, you represent you have authority to bind that organization.
2. The Service
membrAIn is a B2B AI governance gateway. We route your AI SDK calls through our platform to provide encryption, DLP scanning, audit logging, and threat detection.
3. Account Responsibilities
- You are responsible for all activity under your account
- You must provide accurate registration information
- You must keep API keys and credentials secure
- Notify us immediately at security@getmembrain.ai of any unauthorized access
4. Acceptable Use
You may not use membrAIn to violate any law, transmit malware, reverse engineer our platform, or resell the service without a written reseller agreement.
5. Fees and Payment
- Fees charged monthly in advance, non-refundable
- Accounts suspended after 7-day grace period for non-payment
- Price changes communicated with 30 days notice
6. Data
You retain ownership of all data you transmit through our platform. We do not use your data to train AI models. See our Privacy Policy for full details.
7. Intellectual Property
The membrAIn platform, software, and trademarks are our property. Patent applications covering our Ed25519 lineage chain and zero-install governance method are pending.
8. Disclaimer
THE SERVICE IS PROVIDED "AS IS." WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. YOU ARE RESPONSIBLE FOR DETERMINING WHETHER THE SERVICE MEETS YOUR COMPLIANCE REQUIREMENTS.
9. Limitation of Liability
OUR TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
10. Governing Law
These Terms are governed by North Carolina law. Disputes shall be resolved in Mecklenburg County, North Carolina courts.
